Matthew has over 25 years’ experience in advising and helping clients with workplace relations and employment law. Matthew is renowned for his critical thinking, along with pragmatic advice and a direct approach to help solve the client’s specific problems. His approach involves broad thinking and determination to achieve the client goals.
Matthew has a reputation as a fierce and sought after litigator and has run cases in the High Court, Full Court, Federal Court of Australia, Supreme Courts of almost every State & Territory, the Fair Work Commission Full Bench, the Fair Work Commission and many other Courts and Tribunals around the country. He has extensive experience in a variety of interlocutory proceedings (including Restraint enforcement, Anton Piller, Mareva injunctions & preliminary discovery) which are a common theme in many employment and confidentiality cases.
Matthew has acted for a huge array of clients in a broad array of industries from publicly listed companies, multi-nationals (with either onshore & offshore parents), industrial associations to large, medium and small businesses. Matthew also discerningly takes on pro bono matters where capacity allows.
The areas of expertise include but not limited to:
- Development of workplace relations engagement model strategies aligning to business strategic objectives, including but not limited to:
o Enterprise bargaining and agreement making;
o The utilisation of Award facilitative provisions;
o Employment & executive Contract design;
o Policies development;
o Designing, building & tailoring STI, LTI and share options schemes
- Workforce change planning, management including restructures, redundancies and sale/transfer of business issues;
- Wage & entitlement compliance management, including:
o the development and design of wage compliance analysis forensic tools;
o advice on non-compliance risk profiles, rectification options, stakeholder communication planning and advice to executive team/board on risks and remediation processes;
o management of third-party intervention into the remediation process;
- Defending and advising on Unfair Dismissal, General Protections, Sexual Harassment, Discrimination, Workplace Bullying, the management of ill & injured workers and workplace investigations;
- Advising on and the management of work, health and safety compliance issues, including urgent incident response management from minor incidents up to workplace fatalities.
